Extracts from APDR's statute
The Association Partners in Development-Romania is a Romanian juridical person/entity regulated by the Private Law, with non-patrimonial purpose, non-philanthropical, democratic, unconditioned politically or religiously, that will perform information and sensibilization activities in the interest of the citizen/community, according to the Romanian laws and its statute.
The purpose of this association is to facilitate social dialogue in parallel with improving the level of citizen participation in the community life.
The areas where APDR will act are essentially:
Civic education
Children and youth's rights
Fighting against discrimination
Mass media
Promoting and insuring the implementation of specific legislation
Women's rights
Citizen's participation in the local democratic system
Raising awareness about the EU integration
Improving the quality of life.
The Congress of APDR can approve actions/programmes in other areas of activity.
A fundamental goal of our association is to revigor the community spirit by encouraging the active involvement, particularly of the youth.
Other objectives are:
Drafting and implementing information/sensibilisation/ raising awareness campaigns without becoming politically partisan; evaluating/ disseminating/ monitoring the results of the campaigns.
Developing resource/information/training centers;
Developing programmes/activities for the protection and empowerment of marginalized groups;
Creating partnerships with the local/central administration, with other governmental or non-governmental organizations, Romanian or foreign, or with SME's.
Influencing the legislative framework/lobbying for the implementation of the concept of equal chances;
The development of the organization; fund-raising for sustaining our activities.
The membership of APDR is awarded to that person, 18 years old or older that adheres to the APDR's statute, to its strategy and pays the necessary contributions. The Directory Council analyzes the letter of intent of that person, sets an interview, and decides the enlisting of that person as full member of APDR, supported by the written adhesion and the payment of the contribution. By enlisting, the new member agrees to share with APDR his/her financial contribution, his/her knowledge and the work needed for attaining the aim of the association, without the right of withdrawal.
The quality of founding member belongs to all those that participated to the founding of the association and the creation of its patrimony. This quality can also be awarded to those that establish "local branches" based on APDR's statute or to those that participate through special donations or contributions to the "enhancement" of APDR's patrimony.
The quality of honorary member of APDR is awarded by the Congress to that personality that achieve recognition in an important domain for the socio-cultural-scientific life in Romania or in the world, and to those that strongly support the activity of the association.
The rights of APDR's members are:
To get informed about the activities of the association;
To participate in the association's activities;
To participate without the right to vote, to the sessions of the Directory Council;
To forward motions
To be elected in leadership positions.
Each member has the right to vote during the session of the Congress of APDR. This right cannot be exercised by delegation.
The obligations of the members of APDR are:
To know and respect (abide by) the Statute, the Organization and Functioning Code (ROF), the Interior Order Code (ROI) and other documents approved by the Congress.
To pay the contributions and the other taxes;
To inform the association about the changes in his/her identification data (name, address);
To get informed about the activities of the association and to actively take part in these activities;
To promote the association
To improve his/her training.
The membership can be lost in the following circumstances:
written resignation;
failing to pay the contribution for more than one year;
exclusion.
The exclusion of a member can be caused by:
Major violations of the Statute and of the Congress Resolutions;
Causing material and/or moral prejudices to the association;
Evolvement in actions and/or activities that contradict the goal of the association;
Special situations: definitive emigration, death, penal conviction.
The Congress, at the proposal of the Directory Council, decides the exclusions.
Each member will pay the enlistment tax that is also considered as the contribution for that year. The yearly contribution represents one fifth (1/5) of the minimum monthly wage set by law (current in the moment of enlistment). The contribution is paid annually.
For creating local branches, each branch will pay the due contribution to APDR until March 31st. The quantum of this contribution is set by the Congress and is based on the number of members of the branch by December 31st the prior year.
All members residing in the geographical area of activity of a branch of APDR will be enlisted in that particular branch and in the database of APDR.
The Directory Council consists of 7 members, as it follows: a president, a vice-president, a financial coordinator, a secretary, a project coordinator, an image/promotion coordinator (PR) and an administrator.
APDR promotes and aims to facilitate the active involvement of volunteers in the actions it organizes, by acknowledging the following principles:
The voluntary participation, based on freely expressed commitment;
The active involvement of the volunteer in the community life;
The undertaking of the voluntary work with the exclusion of any material compensation from APDR or the beneficiary of the voluntary activity;
The selection of the volunteers is based on equal chances/opportunities, with no discriminations.
The volunteer can be characterized by some of the following features:
Respects the involvement/commitment of other persons;
Respects the rules of democracy and the human values;
Is willing to expand his/her knowledge and to take part in training courses;
Collaborates with the employed personnel;
Accepts to be evaluated.
The volunteer has the following rights:
To actively take part in the elaboration, implementation and evaluation of the programmes for which he/she signed the volunteering contract;
To undertake activities in accordance with his/her professional training, health and psychical and physical resources/abilities;
To be ensured, as the law states, for the accident or health risks, that the activity entails;
To receive the nominal certificate that confirms the volunteer quality/status;
To receive the full reimbursement for the expenses made strictly for the completion of the activity, according to the legislation;
The volunteer has the following obligations:
To fulfill the tasks received from APDR's leadership;
To maintain the confidentiality of the information he/she has access to;
To take part in training courses;
To adequately maintain the goods he/she uses;
To respect the Statute, the Code of Organization and Functioning, the Code for Interior Order, the other internal rules of the association.
The Civil Code regulates the responsibility for the violation or for the unlawful execution of the volunteering contract.
APDR has the following obligations:
To sign a written volunteering contract, according to the law;
To ensure proper conditions for the performing of the voluntary work;
Initiates or ensures the participation of the volunteers in training courses;
Ensures the working safety precaution required by the law, whenever necessary;
Provides the volunteers, within the legal framework, with accident and health insurance, whenever the nature of the activity requires it;
Awards volunteering certificates;
Reimburses , as stated in the contract, within the legal framework, the expenses made for the completion of the activity;
